Any Potential "Investor" in any Mozambique Tourism Development need to read the following very carefully and seriously.

"In terms of Mozambique Land Law 19/97 of 1 October in Mozambique all land is the property of the State, and can be used for a specified period based on the right to use and benefit from the land (Direito de Uso e Aproveitamento de Terra –DUAT). Therefore the concept of “ownership” of property built on land is limited in accordance with the rights of the DUAT-holder. 
In terms of Article 11 of above mentioned;
Foreign persons
Foreign individual and corporate persons may be holders of the right of land use and benefit, provided that they have an investment project that is duly approved and the following conditions are observed:
a) in the case of individual persons, provided that they have been resident in the Republic of Mozambique for at least five years;
b) in the case of corporate persons, provided that they are established or registered in the Republic of Mozambique. 
Therefore they only way foreigners under this law can enjoy the use and benefit of land is by way of having a corprate entity with and approved investment project which in the tourism designated areas will be limited to temporary accommodation. Defined as per Regulation 18/2007 of 07 August, the Tourist Lodging, Restaurants, Drinking Establishments and Dance Halls Regulation (Regulamento de Alojamento Turístico, Restauração eBebidas e Salas de Dança)
Under no circumstances does the above cater for “private ownership” or periodic occupation no matter how some parties try and structure packages.
Realising the investment potential that could be generated from periodic occupation in August 2007 Mozambique introduced of Decree 39/2007 of 24 August, the Periodic Occupation Regulation, Regulamento de Habitação Periódica) Mozambique what is known as“periodic occupation” – that is, concepts such as time-share and fractional ownership, residential tourism occupation (outright ownership) as well as long-term use of business property such as office parks.
The Periodic Occupation Regulation establishes the real rights of those using property constructed on land for which the DUAT belongs to a third party and based on the requirement of certification has a number of factors aimed at investors from unscrupulous developers.
Periodic occupation also offers many opportunities for development in Mozambique, as long as the legislation is followed correctly.
The Periodic Occupation Regulation therefore applies to all property or accommodation used for periodic occupation or residential tourism, and subjectively to all those involved in the ownership, promotion, commercialization thereof.
All periodic occupation premises must be registered with MITUR, and will in exchange receive a certificate demonstrating registration and must have an Information Document which must include:
Name, nationality and residence of the owner of the investment (when natural person);
Name, nationality and residence of the representative of the entity owning theinvestment (when legal person);
Proof of publication of the articles of association of the legal person in the government gazette (BR);
Identification of the investment including the number of the registration of the building or buildings in the real property register, location, status of DUAT application including despatch numbers and validity dates of documents issued; guarantees regarding the completion of the development including methods for repayment of advances given if the development is not completed;
Equipment and services a buyer can expect to have access to, as well as the price per unit;
Information on how the investment will be managed;
Costs of transmission of rights, which the buyer will be responsible for;
Information about rights and time periods in respect of contract resolution, along with contacts of those responsible for dealing with this issue;
License number of the investment if already licensed;
Situation with regard to phases of construction, including planned completion dates if the development is under construction;
Any advertising of periodic occupation rights must include detailed reference to the Information Document, which includes details of the investment and how it accounts. operates, and must include the fact that the Information Document is available for free, as well as explaining how it can be obtained.
The advertising and or commercialization of periodic occupation rights by anyone other than the owner of the investment, or someone duly mandated by the owner, is subject to authorization by the Ministry of Tourism and authorisation to undertake such activity requires written application to MITUR, along with documents demonstrating the right and capability of the applicant toundertake the activity, which include
Proof of constitution and commercial registration of a commercial company;
Certificates of no impediment (certidão de quitação) from the Ministry of Finance and
National Social Security Institute (INSS);
Copies of contracts with the investors responsible for the investments in which periodic occupation rights are being sold"

Do not part with your hard earned money before you ensure the Development and the owners comply with all aspects of the Mozambique Law.

SECURING PROPERTY RIGHTS

No person (national or foreigner) can own land in Mozambique. The rights to use the land for a specific purpose may be granted only by the Government. Such rights (DUAT) can only be registered in the name of a Mozambican citizen, company registered in Mozambique or a foreigner who has been in the country LEGALLY for more than 5 years. DO NOT GET CAUGHT!! Please check all the paperwork given,submit to a good Lawyer and if you get time,please check again. Foreigners are scammed in property transactions on a daily basis and, in most instances, there is no legal recourse

LABOUR CONTRACTS FOR FOREIGNERS

No foreigner is allowed to work in Mozambique without a permit from the Mozambican Government. Even if your company (based elsewhere) sends you to do a short term work project in Mozambique, you will need permission to work here. No tourism VISA (30 days VISA given at the border) gives you permission to work and if you are caught, you will face a huge fine as well as repatriation back to your country of origin (at your own or your employer's cost). It is just not worth it

MOZAMBIQUE  LABOUR LAW

To do business in Mozambique seems a very good option. The economy is growing well, new sectors such as Oil and Gas are attracting huge interest, the tourism industry is well established and it is close to the major economic growth points in Southern Africa.

However, the legal system differs radically from anything else in Southern Africa, the language is Portuguese, the country still follows many procedures which were established under communist and socialist regimes and all land belongs to the government.It all makes for a scenario where you could burn your fingers (and your money) very quickly. “Consultants” and “lawyers” who will “help” you are very common but only a limited number of few success stories emerge because there is no other unbiased, professional, advice platform. We often hear about investors who were “cheated” and it all impacts upon the investment climate of a country which has SO MUCH to offer.There is no official Government Agency which provides the services required by foreign investors and workers as the APEIX organization (previously CPI) is generally not trusted by foreigners as the level of advice provided is incredibly slim.
